Accepting These Terms

This document and the other documents that we reference below make up our house rules, or what we officially call our Terms and Conditions (the “Terms” for short).

The Terms are a legally binding contract between you and FilmLocal Store (we’ll just refer to FilmLocal Store and all of its subsidiaries collectively as “FilmLocal Store”).

Please note that Section 11. Disputes with FilmLocal Store, contains an arbitration clause and class action waiver. By agreeing to the Terms, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions.

This contract sets out your rights and responsibilities when you use FilmLocal Store.com, and the other services provided by FilmLocal Store (we’ll refer to FilmLocal Store.com and other services as our “Services”), so please read it carefully. By using any of our Services (even just browsing one of our websites), you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services.

FilmLocal Store’s Services connect people around the world, both online and offline, to make, sell, and buy goods. Here’s a handy guide to help you understand the specific rules that are relevant for you, depending on how you use the Services:

If you use any of our Services, you agree to these Terms and our Privacy Policy.

Your Privacy

We know your personal information is important to you, so it’s important to us. Our Privacy Policy details how your information is used when you use our Services. By using our Services, you’re also agreeing that we can process your information in the ways set out in the Privacy Policy, so please read it here.

Both FilmLocal Store and sellers process members’ personal information (for example, buyer name, email address, and shipping address) and are therefore considered separate and independent data controllers of buyers’ personal information. That means that each party is responsible for the personal information it processes in providing the Services. For example, if a seller accidentally discloses a buyer’s name and email address when fulfilling another buyer’s order, the seller, not FilmLocal Store, will be responsible for that unauthorised disclosure.  

If, however, FilmLocal Store and sellers are found to be joint data controllers of buyers’ personal information, and if FilmLocal Store is sued, fined, or otherwise incurs expenses because of something that you did as a joint data controller of buyer personal information, you agree to indemnify FilmLocal Store for the expenses it occurs in connection with your processing of buyer personal information. See Section 9. Indemnification (or What Happens If You Get Us Sued) below for more information about your indemnification obligations to FilmLocal Store.

Your Account with FilmLocal Store

You’ll need to create an account with FilmLocal Store to use some of our Services. Here are a few rules about accounts with FilmLocal Store:

  1. You must be 18 or older to use our Services. Otherwise, if you are 13 or older, you may only use our Services under the supervision of a parent or legal guardian who manages your account. Children under 13 are not permitted to use FilmLocal Store or the Services. 
  2. Be honest with us. Provide accurate information about yourself. It’s not OK to use false information or impersonate another person or company through your account.
  3. Choose an appropriate name. If you decide to not have your full name serve as the name associated with your account, you may not use language that is offensive, vulgar, or infringes someone’s intellectual property rights, or otherwise violates the Terms.
  4. You are responsible for your account. You’re solely responsible for any activity on your account. If you’re sharing an account with other people, then the person whose billing information is on the account will ultimately be responsible for all activity. If you’re registering as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are not transferable.
  5. Protect your password. As we mentioned above, you’re solely responsible for any activity on your account, so it’s important to keep your account password secure.
  6. Let’s be clear about our relationship. These Terms don’t create any agency, partnership, joint venture, employment, or franchisee relationship between you and FilmLocal Store.

Your Content

Content that you post using our Services is your content (so let’s refer to it as “Your Content”). We don’t make any claim to it. That includes anything you post using our Services (like shop names, profile pictures, listing photos, listing descriptions, reviews, comments, usernames, etc.).

  1. Responsibility for Your Content. You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.
  2. Permission to Use Your Content. By posting Your Content through our Services, you grant FilmLocal Store a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help FilmLocal Store function and grow. That way, we won’t infringe any rights you have in Your Content and we can help promote your stuff.
  3. Rights You Grant FilmLocal Store. (Here’s the legalese version of the last section). By posting Your Content, you grant FilmLocal Store a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the Services and to promote FilmLocal Store, your FilmLocal Store shop, or the Services in general, in any formats and through any channels, including across any FilmLocal Store Services or third-party website or advertising medium.

Consider these examples: if you upload a photo of a listing on your FilmLocal Store shop, first, we have permission to display it to buyers; if you post a description in English, we can translate it into French so a buyer in Paris can learn the story behind your item; and if you post a beautiful photo of your latest handmade necklace, we can feature it on our homepage, in one of our blogs or even on a billboard to help promote your business and FilmLocal Store’s.

  1. Reporting Unauthorised Content. FilmLocal Store has great respect for intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please contact us at support@filmlocal.com. If Your Content infringes another person’s intellectual property, we will remove it if we receive proper notice. We’ll notify you if that happens.
  2. Inappropriate, False, or Misleading Content. This should be common sense, but there are certain types of content we don’t want posted on FilmLocal Store’s Services (for legal reasons or otherwise). You agree that you will not post any content that is abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive or in violation of any part of our Terms. You also agree not to post any content that is false and misleading or uses the Services in a manner that is fraudulent or deceptive.

Your Use of Our Services

License to Use Our Services. We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services – subject to the Terms and the following restrictions in particular:

  1. Don’t Use Our Services to Break the Law. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal, and international laws that may apply to you. For example, it’s your responsibility to obtain any permits or licenses that your shop requires; you may not sell anything that violates any laws; don’t engage in fraud, theft, anti-competitive conduct, threatening conduct, or any other unlawful acts or crimes against FilmLocal Store, another FilmLocal Store user, or a third party.
  2. Pay Your Bills. You are responsible for paying all fees that you owe to FilmLocal Store. Except as set forth below, you are also solely responsible for collecting and/or paying any applicable taxes for any purchases or sales you make through our Services. VAT (while some countries may refer to VAT using other terms, e.g. GST, we’ll just refer to VAT, GST and any local sales taxes collectively as “VAT”).
  3. Don’t Steal Our Stuff. You agree not to “crawl,” “scrape,” or “spider” any page of the Services or to reverse engineer or attempt to obtain the source code of the Services.
  4. Don’t Try to Harm Our Systems. You agree not to interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.
  5. Follow Our Trademark Policy. The names “FilmLocal Store” and the other FilmLocal Store marks, phrases, logos, and designs that we use in connection with our Services, are trademarks, service marks, or trade dress of FilmLocal Store in the US and other countries. 
  6. Share Your Ideas. We love your suggestions and ideas! They can help us improve your experience and our Services. Any unsolicited ideas or other materials you submit to FilmLocal Store (not including Your Content or items you sell through our Services) are considered non-confidential and non-proprietary to you. You grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.

Termination

Termination By You. We’d hate to see you go, but you may terminate your account with FilmLocal Store at any time from your account settings. Terminating your account will not affect the availability of some of Your Content that you posted through the Services prior to termination. You’ll still have to pay any outstanding bills.

Termination By FilmLocal Store. We may terminate or suspend your account (and any related accounts) and your access to the Services at any time, for any reason, and without advance notice. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Services, for example, to sell or buy on our websites or mobile apps. FilmLocal Store may refuse service to anyone, at any time, for any reason.

If you or FilmLocal Store terminate your account, you may lose any information associated with your account, including Your Content.

We May Discontinue the Services. FilmLocal Store reserves the right to change, suspend, or discontinue any of the Services at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you, including your income or your ability to generate revenue through the Services.

Survival. The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends.

Warranties and Limitation of Liability (or the Things You Can’t Sue Us For)

Items You Purchase. You understand that FilmLocal Store does not manufacture, store, or inspect any of the items sold through our Services. We provide the venue; the items in our marketplaces are produced, listed, and sold directly by independent sellers, so FilmLocal Store can’t and does not make any warranties about their quality, safety, or even their legality. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release FilmLocal Store from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers, or items that caused physical injury (like product liability claims).

Content You Access. You may come across materials that you find offensive or inappropriate while using our Services. We make no representations concerning any content posted by users through the Services. FilmLocal Store is not responsible for the accuracy, copyright compliance, legality, or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.

People You Interact With. You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgment in all interactions with others, especially if you are meeting someone in person.

Third-Party Services. Our Services may contain links to third-party websites or services that we don’t own or control (for example, links to Facebook and Twitter). You may also need to use a third party’s product or service in order to use some of our Services. When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. FilmLocal Store is not a party to those agreements; they are solely between you and the third party.

Warranties. FilmLocal Store is dedicated to making our Services the best they can be, but we’re not perfect and sometimes things can go wrong. You understand that our Services are provided “as is” and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade.

We do not guarantee that: (i) the Services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) the Services will be free of viruses or other harmful materials; or (iv) the results of using the Services will meet your expectations. You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.

Liability Limits. To the fullest extent permitted by law, neither FilmLocal Store, nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the Services or these Terms. In no event shall FilmLocal Store’s aggregate liability for any damages exceed the greater of one hundred ($100) US Dollars or the amount you paid FilmLocal Store in the past twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.

Indemnification (or What Happens If You Get Us Sued)

We hope this never happens, but if FilmLocal Store gets sued because of something that you did, you agree to defend and indemnify us. That means you’ll defend FilmLocal Store (including any of our employees) and hold us harmless from any legal claim or demand (including reasonable attorney’s fees) that arises from your actions, your use (or misuse) of our Services, your breach of the Terms, or your account’s infringement of someone else’s rights.

We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.

Disputes with Other Users

If you find yourself in a dispute with another user of FilmLocal Store’s Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.

Case System. Buyers and sellers who are unable to resolve a dispute related to a transaction on our website may participate in our case system. FilmLocal Store will attempt to help you resolve disputes in good faith and based solely on our interpretation of our policies, in our sole discretion; we will not make judgments regarding legal issues or claims. FilmLocal Store has no obligation to resolve any disputes.

Release of FilmLocal Store. You release FilmLocal Store from any claims, demands, and damages arising out of disputes with other users or parties.

Disputes with FilmLocal Store

If you’re upset with us, let us know, and hopefully we can resolve your issue. But if we can’t, then these rules will govern any legal dispute involving our Services:

  1. Governing Law. The Terms are governed by the laws of the province of Alberta, without regard to its conflict of laws rules, and the laws of the Canada. These laws will apply no matter where in the world you live, but if you live outside of the Canada, you may be entitled to the protection of the mandatory consumer protection provisions of your local consumer protection law.
  2. Arbitration. You and FilmLocal Store agree that any dispute or claim arising from or relating to the Terms shall be finally settled by final and binding arbitration, using the English language, administered by the American Arbitration Association (the “AAA”) under its Commercial Arbitration Rules then in effect (those rules are deemed to be incorporated by reference into this section, and as of the date of these Terms you can find them here or by calling the AAA at 1–800–778–7879). Arbitration will be handled by a sole arbitrator in accordance with those rules. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis – class arbitrations and class actions are not permitted. You understand that by agreeing to the Terms, you and FilmLocal Store are each waiving the right to trial by jury or to participate in a class action or class arbitration. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator. You may instead assert your claim in “small claims” court, but only if your claim qualifies, your claim remains in such court, and your claim remains on an individual, non-representative, and non-class basis.
  3. Costs of Arbitration. Payment for any and all reasonable AAA filing, administrative, and arbitrator fees will be in accordance with the Consumer Arbitration Rules. If the value of your claim does not exceed $1,000, FilmLocal Store will pay for the reasonable filing, administrative, and arbitrator fees associated with the arbitration, unless the arbitrator finds that either the substance of your claim or the relief sought was frivolous or brought for an improper purpose.
  4. Forum. We’re based in Sherwood Park, Alberta, so any legal action against FilmLocal Store related to our Services must be filed and take place in Sherwood Park. That means the seat of any arbitration shall be Sherwood Park. For any actions not subject to arbitration, you (where your contract is with FilmLocal Store) and FilmLocal Store agree to submit to the personal jurisdiction of a state court located in Sherwood Park or where  you and FilmLocal Store agree to submit to the personal jurisdiction of the courts of Ireland.
  5. Government Exception. If you are a government agent or entity in the Canada using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of the Canada (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the province of Alberta.
  6. Modifications. If we make any changes to this “Disputes with FilmLocal Store” section after the date you last accepted the Terms, those changes will not apply to any claims filed in a legal proceeding against FilmLocal Store prior to the date the changes became effective. FilmLocal Store will notify you of substantive changes to the “Disputes with FilmLocal Store” section at least 30 days prior to the date the change will become effective. If you do not agree to the modified terms, you may send FilmLocal Store a written notification (including email) or close your account within those 30 days. By rejecting a modified term or permanently closing your account, you agree to arbitrate any disputes between you and FilmLocal Store in accordance with the provisions of this “Disputes with FilmLocal Store” section as of the date you last accepted the Terms, including any changes made prior to your rejection. If you reopen your closed account or create a new account, you agree to be bound by the current version of the Terms.

That is the end of our general terms, now we will speak about more specific terms for our vendors (people who sell products/items on FilmLocal Store) and buyers (people who purchase any products/items on FilmLocal Store).

Backups

We perform regular backups of the Website and Content and will do our best to ensure completeness and accuracy of these backups. In the event of the hardware failure or data loss we will restore backups automatically to minimize the impact and downtime.

Links To Other Websites

Although this Website may be linked to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their websites. We do not assume any responsibility or liability for the actions, products, services and content of any other third parties. You should carefully review the legal statements and other conditions of use of any website which you access through a link from this Website. Your linking to any other off-site websites is at your own risk.

Vendor Policy

General

FilmLocal Store may remove any listings that violate our policies. FilmLocal Store may also suspend or terminate your account for any violations. You’ll still be on the hook to pay any outstanding fees on your FilmLocal Store bill. 

By selling on FilmLocal Store, you agree that you will:

  1. Provide honest, accurate information in your About section.
  2. Honor your Shop Policies.
  3. Accurately represent your items in listings and listing photos
  4. Respect the intellectual property of others. If you feel someone has violated your intellectual property rights, you can report it to FilmLocal Store.
  5. Not engage in fee avoidance.
  6. Not create duplicate shops. Please see Multiple Shops on FilmLocal Store for more details.
  7. Not coordinate pricing with other sellers.

Support Tickets

You can use FilmLocal Store support tickets to communicate directly with your buyers or other FilmLocal Store members. Support tickets are a great way for buyers to ask you questions about an item or an order.

Support tickets may not be used for the following activities:

  1. Sending unsolicited advertising or promotions, requests for donations or spam;
  2. Harassing or abusing another member or violating our Anti-Discrimination Policy;
  3. Contacting someone after they have explicitly asked you not to; or
  4. Interfering with a transaction or the business of another member.

Interference

Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business. Interference is strictly prohibited on FilmLocal Store. Examples of interference include:Contacting another member via FilmLocal Store to warn them away from a particular member, shop or item;

  1. Posting in public areas to demonstrate or discuss a dispute with another member;
  2. Purchasing from a seller for the sole purpose of leaving a negative review;

Harassment

Any use of FilmLocal Store support tickets to harass other members is strictly prohibited. Similarly, support tickets may not be used to support or glorify hatred.

Privacy and Protecting Personal Information

  • You are responsible for protecting members’ personal information you receive or process. This means that, to the extent you use the Services outside of the Sites or to the extent your local jurisdiction requires it, you must maintain a privacy policy for your shop that is consistent with the privacy terms set forth in FilmLocal Store’s Terms and Conditions (including this Seller Policy) and FilmLocal Store’s Privacy Policy. Such laws may require that you post, and comply with, your own privacy policy, which must be accessible to FilmLocal Store members you interact with and compatible with this policy and FilmLocal Store’s Terms and Conditions.
  • When you sell on FilmLocal Store, you may communicate with other members or have transactions with buyers. This means you may process personal information (for example, buyer name, email address, and shipping address) and may be considered an independent and separate “data controller” under law or other local regulations. If you disclose personal information like a buyer’s name and email address without the buyer’s consent, you are responsible for that unauthorised disclosure.
  • For example, you may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for FilmLocal Store-related communications or for FilmLocal Store-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorised transactions. Without the buyer’s consent, and subject to other applicable FilmLocal Store policies and laws, you may not add any FilmLocal Store member to your email or physical mailing list, use that buyer’s identity for marketing, or obtain or retain any payment information. Please bear in mind that you’re responsible for knowing the standard of consent required in any given instance.
  • If FilmLocal Store and you are found to be joint data controllers of personal information, and if FilmLocal Store is sued, fined, or otherwise incurs expenses because of something that you did as a joint data controller of buyer personal information, you agree to indemnify FilmLocal Store for the expenses it occurs in connection with your processing of buyer personal information.

Creating and Uploading Content

As a member of FilmLocal Store, you have the opportunity to create and upload a variety of content, like listings, text, and photos. In order to keep our community safe and respectful, you agree that you will not upload content that is:

  1. Abusive, threatening, defamatory, harassing;
  2. Obscene or vulgar;
  3. In violation of someone else’s privacy or intellectual property rights; or
  4. False, deceptive, or misleading.

Building a Positive Reputation Through our Reviews System

Reviews are a great way for you to build a reputation on FilmLocal Store. Buyers can leave a review, including a one to five star rating and a photograph of their purchase. Buyers can edit their review, including the photograph.

On the rare occasion you receive an unfavourable review, you can reach out to the buyer.

Reviews and your response to reviews may not:

  1. Contain private information;
  2. Contain obscene, racist, or harassing language or imagery;
  3. Violate our Anti-Discrimination Policy;
  4. Contain prohibited medical drug claims;
  5. Contain advertising or spam;
  6. Be about things outside the seller’s control, such as a shipping carrier, FilmLocal Store or a third party; or
  7. Undermine the integrity of the Reviews system.

Extortion

Extortion is not allowed on FilmLocal Store. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited on FilmLocal Store. Extortion includes when a seller offers a buyer additional goods, services, or compensation in exchange for a positive review.

Shilling

Shilling is strictly prohibited on FilmLocal Store. Shilling is the fraudulent inflation of a shop’s reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the shop’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs or experience of the buyer.

Providing Great Customer Service

We expect our sellers to provide a high level of customer service. By selling on FilmLocal Store, you agree to:

  1. Honor your shipping and processing times. Sellers are obligated to ship an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance. Please be aware that legal requirements for shipping times vary by country. 
  2. Respond to support tickets in a timely manner.
  3. Honor the commitments you make in your shop policies.
  4. Resolve disagreements or disputes directly with the buyer. In the unlikely event that you can’t reach a resolution, our Dispute Resolution team can help through our case system. 
  5. If you are unable to complete an order, you must notify the buyer and cancel the order. 

You may cancel a transaction under the following circumstances:

  1. The buyer did not pay. (The seller may flag a buyer for a payment not received, chargeback or cancelled payment.)
  2. Both you and the buyer agree to cancel the transaction prior to shipment, and you have issued the buyer a full refund.
  3. You have decided to refuse service to the buyer. If the buyer has already paid, you must also issue a full refund, including shipping.
  4. The buyer did not receive the item(s) ordered, even though you provided proof of shipping, and you have issued a refund for the item. (Refunding shipping is optional.)
  5. Both you and the buyer agreed that the buyer could return the item for a refund, you have received the returned item and issued a refund to the buyer for the item. (Refunding shipping is optional.)

FilmLocal Store’s Case System

We ask buyers to contact a seller directly and attempt to resolve any outstanding issues before opening a case on FilmLocal Store. For this reason, it is important that you fill out your shop policies and regularly respond to support tickets from your buyers.

Buyers may file a case for a non-delivery or a not-as-described item. You must respond to any open cases within seven days or the time frame noted by FilmLocal Store in the case. FilmLocal Store reserves the right to escalate a case early for circumstances such as seller inactivity, harassment, refusal of service, case manipulation, and undermining the integrity of the case system.

By using FilmLocal Store’s Case System, you understand that under FilmLocal Store’s dispute resolution procedures, FilmLocal Store may use your personal information for the purpose of resolving disputes with other members. Cases can be filed in the following circumstances:

Non-Delivery

A non-delivery occurs when a buyer places an order and submits payment, but does not receive the item. The following are examples of non-delivery cases:

  1. An item was never sent.
  2. An item was not sent to the address provided on FilmLocal Store.
  3. There is no proof that the item was shipped to the buyer’s address.

Not as Described

An item is not as described if it is materially different from your listing description or your photos. The following are examples of not as described cases:

  1. The item received is a different colour, model, version or size than is shown in the photo or described in the listing.
  2. The item has a different design or material.
  3. The item was advertised as authentic but is not authentic.
  4. You failed to disclose the fact that an item is damaged or is missing parts.
  5. A buyer purchased three items but only received two.
  6. The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new” and the item is used.

Not as Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:

  1. The item(s) were ordered for a specific date or event.
  2. The item(s) are rendered useless after that date.
  3. The seller did not ship the item(s) according to their processing time or the date agreed upon in support tickets.

If FilmLocal Store determines that an item is not as described, you will be required to refund the original shipping and return shipping, in addition to the cost of the item.

Ineligible Transactions

Some disputes don’t qualify for FilmLocal Store’s case system. These include:

  1. Items that have been purchased in person.
  2. Intangible items, services, or prohibited items.
  3. Transactions where payment is not made through FilmLocal Store.
  4. Items that are returned without a return agreement.
  5. Items that have been altered, used, worn, or washed after receiving them.
  6. Physical or tangible items that are not available for return because they have been destroyed or discarded by the buyer.
  7. Items that are received after the agreed-upon delivery date due to shipping delays.
  8. Cost of shipping disputes.

When a dispute is ineligible for our case system, we encourage both parties to work together to come to an amicable solution.

Transaction Fees

  • When you make a sale through FilmLocal Store.com, you will be charged a transaction fee of 10% of the price you display for each listing.

Fee Avoidance

  • Any action by a seller to avoid paying a fee is considered fee avoidance and is strictly prohibited by FilmLocal Store. This includes, for example, encouraging buyers to purchase an item in your FilmLocal Store shop through another venue. A transaction initiated on FilmLocal Store may not be completed off of FilmLocal Store. The price stated in each listing description must be an accurate representation of the sale. Sellers may not charge excessive shipping fees. Sellers may not alter the item’s price after a sale for the purpose of avoiding FilmLocal Store transaction fees, misrepresent the item’s location, or use another user’s account without permission.

Taxes

  • You are responsible for collecting and paying any taxes associated with using and making sales through FilmLocal Store’s services.
  • If you sell physical goods on FilmLocal Store and reside in the US or Canada, you have the option of either including applicable taxes in your listing prices, or excluding applicable taxes from your listing prices. For items shipped to Washington State (or, for digital items, those purchased with a Washington state billing address), FilmLocal Store will use the category you assigned to the listing(s) to calculate, collect and remit the applicable sales tax. You are solely responsible for ensuring that all of your listings are properly categorised and you agree to indemnify FilmLocal Store for any losses it incurs in connection with any miscategorisation of your listings by you.
  • If you sell physical goods on FilmLocal Store and reside outside of the US and Canada, you need to include all applicable taxes in your listing prices. 
  • FilmLocal Store will issue 1099-K forms to certain sellers in the United States to comply with IRS requirements.
  • To learn more about how VAT works in certain countries, please contact a professional. For digital items sold to buyers in the EU, Norway, Russia, South Korea, South Africa, Switzerland, New Zealand, or India, FilmLocal Store will help you collect and remit VAT as described above in the Digital VAT Fees section.
  • Please remember that FilmLocal Store’s fees do not include any withholding taxes that might apply in your home country. You are required to pay FilmLocal Store the full amount of our fees and may not deduct any applicable withholding taxes from that amount. Please also note that some countries require FilmLocal Store to charge VAT on certain of the fees that you may be charged in accordance with this policy, and that the fees listed in this policy do not include that VAT.

Being Transparent About Your Business

At FilmLocal Store, we value transparency. Transparency means that you honestly and accurately represent yourself, your items and your business. You agree to:

  1. Disclose in your About section the names and roles of people who help make your items or run your business;
  2. Use your own words and photographs (not stock photos) to describe your items; and
  3. Respond to any inquiries from us in a timely manner. We may ask you how your items are made, what workspace, tools and equipment you use; and how you communicate and collaborate with the people who help you run your shop.

Remember: Our market is built on trust. Providing false, inaccurate, or misleading information is prohibited by our Terms and Conditions. We would hate to do it, but if we find that you’re not being open and honest with us, we may suspend or terminate your account.

Intellectual Property Rights

  • As a venue for artists, designers, and makers, FilmLocal Store takes intellectual property rights very seriously. We comply with intellectual property laws and industry best practices in order to maintain the integrity of our creative marketplace. This policy explains how we address allegations of infringement, how authorised parties can submit proper notices of infringement regarding content on our marketplace, and how FilmLocal Store sellers can respond when their listings or shops are affected by a notice.

Reporting

  • If you would like to submit a notification of alleged infringement, counter a notice of copyright infringement submitted against you, or withdraw a notification of infringement that you submitted, please contact us at support@filmlocal.com

Policy

  • FilmLocal Store adopted this intellectual property policy in accordance with industry best practices, general U.S. intellectual property laws, and the Digital Millennium Copyright Act.

Notices of Intellectual Property Infringement

  • FilmLocal Store strives to respond quickly when we receive proper notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When FilmLocal Store removes or disables access in response to a notice, FilmLocal Store makes a reasonable attempt to contact the allegedly infringing party, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about counter notification. FilmLocal Store may also provide a copy of the notice to the allegedly infringing party.

Counter Notification

  • If FilmLocal Store receives a DMCA counter notification, the removed material may be replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs FilmLocal Store of this action. FilmLocal Store sends a copy of the counter notice to the original complaining party.

Repeat Infringement

  • FilmLocal Store terminates account privileges of members that are subject to repeat notices of intellectual property infringement in appropriate circumstances and at FilmLocal Store’s discretion.

Creating and Uploading Content

As a member of FilmLocal Store, you have the opportunity to create and upload a variety of content, like listings, text, and photos. In order to keep our community safe and respectful, you agree that you will not upload content that is:

  1. Abusive, threatening, defamatory, or harassing;
  2. Obscene or vulgar;
  3. In violation of someone else’s privacy or intellectual property rights; or
  4. False, deceptive, or misleading.

Legal

  • You are solely responsible for posting and complying with your own shop policies. We encourage you to use the shop policy tools offered by FilmLocal Store to provide clear information to your buyers.
  • We hope these guidelines are helpful, but we cannot catalog every permitted or prohibited item. We reserve the right to remove listings that we determine are not within the spirit of FilmLocal Store. Such listings will be removed from the site, and the member’s selling privileges may be suspended and/or terminated.
  • If you see something on FilmLocal Store that appears to violate these rules, you can report it to us. 

This policy is a part of our Terms and Conditions. By using any of our Services, you agree to this policy and our Terms and Conditions.

This policy applies to anyone that uses our Services, regardless of their location. It is up to you to familiarise yourself with these restrictions.

In order to protect our community and marketplace, FilmLocal Store takes steps to ensure compliance with sanctions programmes. For example, FilmLocal Store prohibits members from using their accounts while in certain geographic locations. If we have reason to believe you are operating your account from a sanctioned location, such as any of the places listed above, or are otherwise in violation of any economic sanction or trade restriction, we may suspend or terminate your use of our Services. Members are generally not permitted to list, buy, or sell items that originate from sanctioned areas. This includes items that pre-date sanctions, since we have no way to verify when they were actually removed from the restricted location. FilmLocal Store reserves the right to request that sellers provide additional information, disclose an item’s country of origin in a listing, or take other steps to meet compliance obligations. We may disable listings or cancel transactions that present a risk of violating this policy.

FilmLocal Store members should be aware that other countries may have their own trade restrictions and that certain items may not be allowed for export or import under international laws. You should consult the laws of any jurisdiction when a transaction involves international parties.

Finally, FilmLocal Store members should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block transactions as part of their own compliance programmes. FilmLocal Store has no authority or control over the independent decision-making of these providers.

The economic sanctions and trade restrictions that apply to your use of the Services are subject to change, so members should check sanctions resources regularly. Below are some examples for educational purposes only. For legal advice, please consult a qualified professional.

  • If your shop and the order in question satisfy the eligibility requirements, FilmLocal Store will try to help you resolve Non-Delivery cases, Not as Described cases, and chargebacks. We may have to request additional information from you. For Non-Delivery or Not as Described cases, we’ll need you to respond to our inquiries within 7 calendar days or the time frame noted by FilmLocal Store in the case. If a chargeback is filed against you, we’ll need you to respond to any inquiries from FilmLocal Store as soon as possible, and no later than 5 calendar days. If you don’t give us the necessary information in time, we may not be able to help resolve the dispute. Please keep in mind that we can’t guarantee a resolution in your favour.

. Shipping Your Items

Sellers are responsible for shipping their sold items to buyers. If you’re using a shipping or fulfillment service, please keep in mind that you are ultimately responsible for making sure that your buyers receive the item(s) they purchased from your shop.

By selling on FilmLocal Store, you agree to:

  • Provide an accurate “ships from” address.
  • Specify your shipping costs and processing times in your listings.
  • Ship items promptly after they are sold. Prompt shipping means that you ship each item within 30 days of purchase, unless you specify otherwise in your processing time or agree to a different shipping period with the buyer through support tickets.
  • Comply with all local and international shipping and customs regulations. 
  • Shipping to the wrong address is likely to result in a non-delivery case, so make sure to ship to the address listed on FilmLocal Store.
  • Charge an appropriate amount for shipping.

By entering tracking information on FilmLocal Store, you’re giving us permission to collect and share the tracking information received from your chosen shipping carrier with the buyer.

  • In the unlikely event an order does not arrive, be prepared to provide valid proof of shipping. Valid proof of shipping must show that the item actually was shipped and that it was sent to the address provided on FilmLocal Store. If a buyer does not receive their order, they may file a case against your shop.

Shipping Insurance

Shipsurance Insurance

  • You may purchase parcel insurance from Shipsurance Insurance Services, Inc. for packages that are shipped using USPS or FedEx shipping labels. If you choose to purchase insurance from Shipsurance, you agree to the Shipsurance Coverage Rules.

Canada Post Insurance

  • You may purchase parcel insurance from Canada Post for packages that are shipped using Canada Post shipping labels. Insurance claims for packages sent using Canada Post labels are handled exclusively by Canada Post.

Fees

  • The cost of a shipping label will depend on the origin, destination, weight and dimensions of the package. If you add signature confirmation or insurance, those fees will be added to the total cost of the label at the point of purchase. All fees for USPS and FedEx shipping labels and for Shipsurance and Canada Post parcel insurance will appear separately on your FilmLocal Store bill and will specify the name of the service provider and the shipping label number.

Buyer Policy

Understanding FilmLocal Store’s Limitations as a Venue

FilmLocal Store (which we will refer to as ‘FilmLocal Store’ throughout this policy) provide a venue for buyers to find, learn about, and enter into transactions with sellers around the world. It is important to note, however, that FilmLocal Store is not a part of that transaction. By shopping on FilmLocal Store, you understand that:

  1. You are not buying directly from FilmLocal Store, but from one of the many talented sellers on FilmLocal Store;
  2. FilmLocal Store does not pre-screen sellers and therefore does not guarantee or endorse any items sold on FilmLocal Store or any content posted by sellers (such as photographs or language used in listings or shop policies); and
  3. Each seller on FilmLocal Store accepts different payment methods and has their own processing times, shipping methods and shop policies.

You can use FilmLocal Store’s support tickets tool to communicate directly with sellers or other FilmLocal Store members. support tickets are a great way to ask sellers any questions you have about an item or an order. Support tickets may not be used for the following activities:

  1. Sending unsolicited advertising or promotions, requests for donations or spam;
  2. Harassing or abusing another member.
  3. Contacting someone after they have explicitly asked you not to; or
  4. Interfering with a transaction or the business of another member.

Interference

Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business. Interference is strictly prohibited on FilmLocal Store. Examples of interference include:

  1. Contacting another member via FilmLocal Store support tickets to warn them away from a particular member, shop or item;
  2. Posting in public areas to demonstrate or discuss a dispute with another member;
  3. Purchasing from a seller for the sole purpose of leaving a negative review

Harassment

Any use of FilmLocal Store support tickets to harass other members is strictly prohibited. Similarly, support tickets may not be used to support or glorify hatred.

When you buy from a shop on FilmLocal Store, you’re directly supporting an independent business, each with its unique listings, policies, processing times and payment systems. By making a purchase from a seller on FilmLocal Store, you agree that you:

  1. Have read the item description and shop policies before making a purchase;
  2. Have submitted appropriate payment for item(s) purchased; and
  3. Have provided accurate shipping information to the seller.

Leaving a Review of an Item

Reviews are a great way to learn about a seller’s items, help good sellers build a strong reputation, or help warn other buyers about a poor experience.

You can leave a review, including a one to five star rating and a photograph of your purchase.

By leaving a review or photograph, you acknowledge that:

  1. Your review and/or photograph and profile information will be publicly displayed on the seller’s listing and review pages.
  2. Reviews and photographs may not:
  3. a. Contain private information;
  4. b. Contain obscene, racist or harassing language or imagery;
  5. c. Violate our policy
  6. d. Contain prohibited medical drug claims;
  7. f. Contain advertising or spam;
  8. f. Be about things outside the seller’s control, such as a shipping carrier, FilmLocal Store, or a third party; or
  9. h. Undermine the integrity of the Reviews system.
  10. Extortion is not allowed on FilmLocal Store. Any attempt to manipulate reviews through threats, intimidation or bribery is considered extortion and is strictly prohibited on FilmLocal Store. Examples of extortion include the following:
  11. a. A buyer leaves a negative review in an attempt to force the seller into providing additional items that were not agreed upon in the original transaction.
  12. b. A buyer leaves a negative review in an attempt to force the seller into providing a refund when a refund is not warranted.
  13. Shilling is not allowed on FilmLocal Store. Shilling is the fraudulent inflation of a shop’s reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the shop’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs or experience of the buyer.

By uploading a photograph to one of FilmLocal Store’s websites:

  1. You own the photograph or you have the rights or permission to use the photograph; and
  2. You understand that, as stated in FilmLocal Store’s Terms and Conditions, FilmLocal Store has license to use any content you provide to FilmLocal Store.

We reserve the right to remove reviews or photographs that violate our policies or Terms and Conditions.

Reporting a Problem with an Order or Returning an Item

FilmLocal Store’s Case System

Although FilmLocal Store is not directly involved in a transaction between a buyer and a seller, we provide a case system in the unlikely event your purchase from a seller does not go as expected. You can use FilmLocal Store’s case system to come to a resolution with the seller in the event of a non-delivery or if an item you receive is not as described in the listing. By using FilmLocal Store’s Case System, you understand that under FilmLocal Store’s dispute resolution procedures, FilmLocal Store may use your personal information for the purpose of resolving disputes with other members. You can file a case under the following circumstances:

Non-Delivery

A non-delivery occurs when a buyer places an order and submits payment, but the seller does not ship the item or does not ship the item to the correct address. The following are examples of non-delivery cases:

  1. An item was never sent.
  2. An item was not sent to the address provided on FilmLocal Store.
  3. There is no proof that the item was shipped to the buyer’s address.

Not as Described

An item is not as described if it is materially different from the seller’s listing description or photos. Here are a few examples of not as described cases:

  1. The item received is a different colour, model, version or size.
  2. The item has a different design or material.
  3. The item was advertised as authentic but is not authentic.
  4. The seller failed to disclose the fact that an item is damaged or is missing parts.
  5. A buyer purchased three items but only received two.
  6. The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new” and the item is used.

Not as described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:

  1. The item(s) were ordered for a specific date or event.
  2. The item(s) are rendered useless after that date.
  3. The seller did not ship the item(s) according to their processing time or the date agreed upon in support tickets.

If FilmLocal Store determines that an item is not as described, the seller will be required to refund the original shipping and return shipping, in addition to the cost of the item. 

Ineligible Transaction

Some disputes don’t qualify for FilmLocal Store’s case system. These include:

  1. Items that have been purchased in person.
  2. Intangible items, services, or prohibited items.
  3. Transactions where payment is not made through FilmLocal Store.
  4. Items that are returned without a return agreement.
  5. Items that have been altered, used, worn, or washed after receiving them.
  6. Physical or tangible items that are not available for return because they have been destroyed or discarded by the buyer.
  7. Items that are received after the agreed-upon delivery date due to shipping delays.
  8. Cost of shipping disputes.

Requesting a Cancellation

Only sellers may cancel transactions. Buyers may request that a seller cancel an order via support tickets

Discrimination

On FilmLocal Store, you can’t discriminate based upon:

  • Race
  • Colour
  • Ethnicity
  • National origin
  • Religion
  • Gender
  • Gender identity
  • Sexual orientation
  • Disability
  • Any other characteristic protected under applicable law

It is your responsibility as a seller or buyer to know your local laws and any other legal regulations on discrimination that might apply to you.

Whether you’re listing items on FilmLocal Store, discrimination is not allowed. Examples of prohibited behaviour on FilmLocal Store include, but are not limited to:

  • Refusal of service based on membership in one or more protected group
  • Derogatory or demeaning remarks against protected groups listed above
  • Racial slurs
  • Posts that support or glorify current or historical hate groups

If you think discrimination has occurred on FilmLocal Store, please report it by e-mailing dispute-support@filmlocal.com and we will investigate.

The Policy is a legally binding contract between you and FilmLocal Store.

Disputes

Disputes. Sellers agree to resolve any disputes directly with a buyer or with the assistance of the dispute management and refund tools available on FilmLocal Store, and in accordance with our Seller Policy and Terms and Conditions. In the event that a dispute is escalated to FilmLocal Store’s Support Team, FilmLocal Store reserves the right to issue a refund to a buyer if a transaction is found to be in violation of FilmLocal Store’s Seller Policy and Terms and Conditions.

FilmLocal Store reserves the right to recoup funds associated with buyer chargebacks.

Appointment of FilmLocal Store as Limited Collection Agent for Sellers

Each seller appoints FilmLocal Store as its agent for the limited purpose of receiving, holding and settling payments to seller. FilmLocal Store will settle payments that are actually received by FilmLocal Store to each seller, less any amounts owed to FilmLocal Store and subject to these Terms. Each seller agrees that a buyer payment received by FilmLocal Store, on behalf of seller, satisfies the buyer’s obligations to make payment to seller, regardless of whether FilmLocal Store actually settles such payment to seller. If FilmLocal Store does not settle any such payments as described in these Terms to a seller, such seller will have recourse only against FilmLocal Store and not the buyer.

If we believe that a seller’s actions may result in buyer disputes, chargebacks, or other claims, then we may, in our sole discretion, put (1) a hold, (2) a deposit delay, or (3) a reserve on the seller’s payment account balance.

A hold may be put on funds associated with a particular transaction if there is a dispute or investigation related to the order, for the shorter of: (a) 180 days after the estimated delivery date; or (b) completion of any investigation regarding the seller’s actions.

If FilmLocal Store places a hold, a deposit delay or a reserve on a seller’s account, we’ll do our best to communicate with the affected seller as soon as we can.

We always work hard to avoid and minimise any delays. However, please note that FilmLocal Store is not obligated to refund any fees or reimburse any expenses due to holds or delayed deposits.

Recoupment

  1. We reserve the right, in our sole discretion, to seek reimbursement from a seller in any of the following circumstances: (a) we provide a refund to a buyer because a seller did not promptly deliver the goods or we otherwise determine that a refund is warranted in a particular circumstance, (b) we discover erroneous or duplicate transactions related to a seller, (c) we receive a chargeback from a buyer’s credit card issuer or reversal of payment for the amount of a buyer’s purchase from a seller, or (d) a seller does not act in accordance with FilmLocal Store’s Terms and Conditions or any policy thereunder.
  2. We may obtain reimbursement of any amounts owed by a seller to FilmLocal Store by deducting from future payments owed to the seller, reversing any credits to the seller’s payment account balance, charging the seller’s credit card on file, charging the seller’s bill, or seeking reimbursement from the seller by any other lawful means, including by using third-party collections services. You authorise us to use any or all of the foregoing methods to seek reimbursement.

Termination

Sellers may terminate this contract any time by adjusting the Settings in their account with FilmLocal Store. FilmLocal Store may also terminate or suspend a seller’s use of FilmLocal Store Payments at any time.

Upon termination, any non-disputed available balance will be deposited into a seller’s bank account. FilmLocal Store reserves the right to set off against any payments to be made to the seller, an amount determined by us to be adequate to cover any anticipated chargebacks, refunds, adjustments or other amounts that might be paid to buyers in connection with purchases from the seller’s payment account for a prospective 180-day period. At the end of the 180-day period following termination, we will disburse to the seller any amount not used to offset chargebacks, refunds, adjustments, or such other amounts paid to buyers, or seek reimbursement from the seller via any of the means authorised in this Policy for any additional amount required to offset chargebacks, refunds, adjustments, or other amounts paid to buyers, as applicable.

Buyer Case Resolution

If you’re looking to return an item or get a refund from an order on FilmLocal Store, the first thing to do is contact the seller directly. Each seller has their own shop policies that should address issues like these.

If you’ve reached out to the seller and haven’t heard back, or if you’re unable to resolve your issue together, you can file what’s known as a “case.”

With FilmLocal Store’s case system, members work together to resolve disputes that result in a non-delivery or are not as described.

You must have an FilmLocal Store account to open a case. That means that if you purchase an item using guest checkout, you’ll have to register for an account on FilmLocal Store before you can file a case.

Case time eligibility

Case eligibility is calculated by taking the processing time and adding a shipping time of 4 business days for domestic orders and 10 business days for international orders.

If a seller does not provide processing times:

  • 5 business days will be automatically added as the default processing time.

If your order contains multiple items:

  • If each item has different processing times, the item with the longest processing time will be used to determine eligibility for the entire order.
  • If no processing time is given for any of the items in your order, the longest processing time will still be used. This would include the automatic 5-business day processing time if that happens to be the longest.

If your order has a processing time, you can open a case until either:

  • 100 days after the expected “ship by” date (+ relevant processing times); or
  • 100 days after the order is marked as shipped (+ relevant processing times).

Whichever of these dates happens first will determine the end of the case eligibility period.

Please note: If you were advised by FilmLocal Store to contact PayPal for a refund, you may have a limited time frame in which to file a claim for refund of purchase under PayPal’s policies.

Transaction eligibility

There are two types of cases that a buyer can open:

1) a non-delivery case

or

2) a not-as-described case

A non-delivery occurs when a buyer places an order and submits payment, but does not receive the item. A few examples of non-delivery cases:

  • An item was never sent.
  • An item was sent to an address that is not on the FilmLocal Store receipt.
  • There is no proof that the item was shipped to the delivery city/state and zip code.

Note: FilmLocal Store doesn’t hold sellers responsible for shipping delays or errors, as long as the seller can prove that they shipped the item to the address on the FilmLocal Store receipt. If the item was shipped and the seller has a tracking number, the seller may be able to open a claim with the shipping service.

An item is not as described if it is materially different from the seller’s listing description and photos. Here are a few examples of not-as-describedcases:

  • The item received is a different color, model, version, or size.
  • The item has a different design or material.
  • The item was advertised as authentic but is not authentic.
  • The seller failed to disclose the fact that an item is damaged or is missing parts.
  • A buyer purchased three items but only received two.
  • The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new, ” and the item is used.

Not-as-described cases can also be filed for late delivery. To qualify for late delivery, the buyer must provide proof that all of these conditions have been met:

1.) The item(s) were ordered for a specific date or event.

2.) The item(s) are rendered useless after that date.

3.) The seller did not ship the item(s) according to their processing time or the date agreed upon in Conversations.

If an item is materially similar to the seller’s listing description and photos, it would not be eligible for a not-as-described case. Here are a few examples of what would not qualify as not as described:

  • The defect in the item was correctly described by the seller.
  • The item was properly described, but the buyer simply did not want it after they received it.
  • The item was properly described but did not meet the buyer’s expectations.
  • The item has signs of wear and was correctly described as used condition.
  • The item was damaged during shipment.

Ineligible transactions

Some transactions on FilmLocal Store will not qualify for the case system. Some may violate FilmLocal Store’s policies. Others may not be covered by FilmLocal Store’s case system. Some examples:

  • Items that are purchased in person
  • Intangible items, including services
  • Prohibited items on FilmLocal Store
  • Transactions where payment is not made via FilmLocal Store’s checkout system
  • Items that are returned without a return agreement
  • Items that have been altered, used, worn or washed after receiving
  • Physical or tangible items that are not available for return
  • Items that are received after the agreed-upon delivery date due to shipping delays
  • Cost of shipping disputes
  • Cases that have closed due to lack of participation

If a seller doesn’t respond or resolve the case within one week from the date it was opened, the buyer can escalate the case for review by FilmLocal Store Dispute Resolution. FilmLocal Store reserves the right to escalate a case early for circumstances such as seller inactivity, harassment, refusal of service, case manipulation, and undermining the integrity of the case system.

If the seller doesn’t resolve the case, FilmLocal Store may issue a refund on the seller’s behalf.

Changes to the Terms

We may update these Terms from time to time. If we believe that the changes are material, we’ll definitely let you know by doing one (or more) of the following: (1) posting the changes through the Services or (2) sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

Some Finer Legal Points

The Terms, including all of the policies that make up the Terms, supersede any other agreement between you and FilmLocal Store regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.
